Governing use of the Nodestreak website and the AI Readiness Audit process. Please read these Terms carefully before using nodestreak.com.
These Terms of Service (the "Terms") govern your access to and use of https://nodestreak.com (the "Website"), operated by Nodestreak ("Nodestreak," "we," "us," or "our"), including any content, functionality, forms, and services made available on or through the Website, such as the "Book Free AI Audit" flow. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
These Terms do not, by themselves, constitute an agreement for Nodestreak to design, build, host, or operate any AI system for you. Any such engagement is governed by a separate, signed Master Services Agreement and Statement of Work, as described in Section 6.
The Website is intended for business professionals evaluating AI agent and automation services for an organisation. By using the Website, you represent that you are at least eighteen (18) years old and, where you submit an enquiry on behalf of an organisation, that you are authorised to do so.
The Website provides information about Nodestreak's AI agent, RAG, automation, computer vision, predictive analytics, and related capabilities; illustrative pricing tiers; industry case studies; and a mechanism to book a complimentary AI Readiness Audit or otherwise contact Nodestreak. Content on the Website, including indicative pricing, ROI figures, and case-study outcomes, is provided for general informational purposes, reflects illustrative or historical client results, and does not constitute a binding offer, quotation, or guarantee of any particular outcome for your organisation. Final scope, pricing, timelines, and deliverables for any Client Engagement are set out exclusively in a signed Statement of Work.
Where you book a free AI Readiness Audit or discovery call through the Website, Nodestreak will use reasonable efforts to provide general observations and indicative recommendations based on the information you share. The AI Readiness Audit is provided for discussion purposes only, does not constitute professional, legal, medical, financial, or regulatory advice, and does not create any Client Engagement, fiduciary duty, or obligation on Nodestreak to perform further work. Nodestreak may decline to proceed with any enquiry or booking at its discretion, including where a proposed use case falls within an Unacceptable or prohibited use under the Nodestreak AI Design Policy or AI Acceptable Use Policy.
If you proceed to engage Nodestreak to design, build, integrate, host, or maintain an AI system, that engagement will be governed by a separate, mutually executed Master Services Agreement and Statement of Work, which will take precedence over these Terms in the event of a conflict regarding the scope of that engagement. Every AI system Nodestreak delivers to a client is designed, evaluated, deployed, and monitored in line with the Nodestreak AI Design Policy (NS-POL-AID-001), and its use is subject to the Nodestreak AI Acceptable Use Policy (NS-POL-AUP-001), both of which are incorporated by reference into every Client Engagement and are available on request.

The Website and its Content, including text, graphics, logos, the Nodestreak name and marks, case studies, and the arrangement and design of the Website, are owned by or licensed to Nodestreak and are protected by applicable intellectual property laws. Except as expressly permitted by these Terms or applicable law, you may not reproduce, distribute, modify, publicly display, or create derivative works from any Content without Nodestreak's prior written consent. You may view, download, and print Content solely for your own internal, non-commercial evaluation of Nodestreak's services.
Ownership of any deliverables, code, models, prompts, or other work product created for you under a Client Engagement is governed exclusively by the applicable Statement of Work, consistent with Section 4.6 of the Nodestreak AI Acceptable Use Policy.
If you send Nodestreak feedback, ideas, or suggestions relating to the Website or our services, you grant Nodestreak a non-exclusive, worldwide, royalty-free, perpetual licence to use that feedback for any purpose, without obligation to compensate you, unless we agree otherwise in writing. Do not submit any information through the Website that you do not have the right to share, or that is confidential to a third party, including a current employer or client, without that party's authorisation.
The Website contains links to, and integrations with, third-party platforms, including LinkedIn, Facebook, and the WhatsApp Business Platform operated by Meta. Nodestreak does not control and is not responsible for the content, availability, security, or practices of these third-party platforms. Your use of any third-party platform is governed by that platform's own terms and privacy policy.
Our collection and use of personal data through the Website is described in the Nodestreak Privacy Policy (NS-POL-PRIV-001), which is incorporated into these Terms by reference. By using the Website, you acknowledge that you have read the Privacy Policy.
THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. INDICATIVE ROI FIGURES, PRICING RANGES, AND CASE-STUDY OUTCOMES DESCRIBED ON THE WEBSITE REFLECT PAST OR ILLUSTRATIVE RESULTS AND ARE NOT A GUARANTEE OF FUTURE PERFORMANCE FOR YOUR ORGANISATION. NOTHING ON THE WEBSITE CONSTITUTES LEGAL, MEDICAL, FINANCIAL, OR REGULATORY ADVICE.
To the fullest extent permitted by applicable law, Nodestreak and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or relating to your use of, or inability to use, the Website, even if advised of the possibility of such damages. To the fullest extent permitted by applicable law, Nodestreak's aggregate liability arising out of or relating to your use of the Website shall not exceed one hundred United States dollars (USD 100). This Section does not limit liability that cannot be limited or excluded under applicable law, and does not apply to liability arising under a signed Client Engagement, which is governed by the limitation of liability provisions of that agreement.
You agree to indemnify and hold harmless Nodestreak and its officers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your misuse of the Website, your violation of these Terms, or your violation of any applicable law or third-party right.
These Terms are governed by, and shall be construed in accordance with, the laws applicable in the United Arab Emirates free zone in which Nodestreak is registered, without regard to conflict-of-law principles. Subject to Section 16, the courts of that jurisdiction shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the Website, and each party submits to the exclusive jurisdiction of those courts. Nothing in this Section affects any mandatory consumer-protection or data-protection rights you may have under the law of your own place of residence.
If a dispute arises out of or relates to these Terms, the parties will first attempt in good faith to resolve it through informal negotiation by contacting hello@nodestreak.com. If the dispute is not resolved within thirty (30) days, either party may pursue the matter before the courts identified in Section 15, or, where the parties separately agree in writing, through arbitration.
We may suspend or restrict your access to the Website, in whole or in part, at any time and without notice, where we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, or where necessary to protect the security or integrity of the Website. Sections 8, 9, 12, 13, 14, and 15 survive any termination of your access to the Website.
We may update these Terms from time to time to reflect changes in our practices, our services, or applicable law. The "Effective Date" at the top of these Terms indicates when they were last revised. Your continued use of the Website after an update constitutes acceptance of the revised Terms. Where a change is material, we will provide reasonable notice on the Website.
These Terms are intended to operate alongside, and are informed by, the Nodestreak AI Design Policy (NS-POL-AID-001) and the Nodestreak AI Acceptable Use Policy (NS-POL-AUP-001), issued in alignment with ISO/IEC 42001:2023, and applicable law including the UAE AI Charter, UAE PDPL, SDAIA AI Ethics Principles, KSA PDPL, Qatar NCSA framework, Pakistan PECA 2016 and PDPB, and, where applicable, the EU AI Act (Regulation (EU) 2024/1689) and GDPR.
